<p>More corrections to the media. This time in my home-town newspaper.</p>
<p>The definition of a short sale is: convincing the bank to accept less than the current balance owed as payment in full. Of course, the problem is, most of the current short sale tranactions leave open the possiblity for the lender to come back in the future for the difference, or mortgage deficiency. Contracting an experienced investor to negotiate your short sale can eliminate that possibility. </p>
<p>The huge advantage is that when you want to buy a house again in the future, a lender will be much more receptive to approving your loan seeing that you faced your financial reality and cooperated with your former lender. It will be much easier to repair your credit. (You might consider engaging a credit repair company as you recover your future financial stability.)</p>
<p>We now know that mortgage modification is a do-it-yourself project for 2011. The Federal Trade Commission has made it virtually impossible for any third party to make a profit by negotiating mortgage modifications. The REST Report has proven itself as a fail-proof tool to get the best mortgage modification available and prevent illegal foreclosure. </p>

<p>After ten months of of the Home Affordable Mortgage Plan, or HAMP, the rules for applying for a mortgage short sale now duplicate the mortgage modification process. We all hope it speeds up the notoriously slow short sale process. One glaring fact remains however. Whether a mortgage modification or a short sale, the chances of a distressed homeowner obtaining a timely and beneficial mortgage solution are slim and none without professional assistance.</p>
<p>The mortgage servicers know that they make more money on any given foreclosure. Treachery is their prime objective. They exist to make money. Mortgage modifications and short sales don&#8217;t make money. They make money by charging late fees and foreclosure.They have no &#8216;skin in the game.&#8221; They don&#8217;t lose new home purchase documents. Why do you suppose they can&#8217;t find mortgage modification or short sale documents?</p>
<p>Your mortgage investor, on the other hand, only benefits from mortgage modification or short sale. They do not benefit from foreclosure &#8211; or Deed-in-Lieu.</p>
<p>When I had my homework completed on time in school, I had no problem turning it in. When I didn&#8217;t have it, I spent the 35 minutes on the bus to school conjuring up some other good excuse other than my non-existent pet dog to blame it on. Before I had my driver&#8217;s license, I couldn&#8217;t use the old flat-tire excuse that the older kids used.</p>
<p>The solution is to use the lender&#8217;s software to calculate a beneficial mortgage modification or short sale, and then file it as a legal document. My investors are prepared to make a cash offer to your mortgage investor that they require to negotiate a beneficial short sale for the distressed homeowner.</p>
<p>Today I read yet another story about a qualified prospective homeowner attempting to buy a short sale property. Every piece is in place, except the REST Report that can force the lenders to behave and perform.</p>
<p>The wanna-be homebuyer has been waiting for ten months. There is no information on the seller. My investor and negotiator would have consumated a double close in less than sixty days. These poor souls would have been in their home for eight months now. Someone in this transaction is being greedy. The distressed seller, the listing real estate agent, the new homebuyer, the lenders, or the buyer&#8217;s real estate agent. Is there money involved with an intermediary investor such as the the one I represent? Yes, there is. But for these concerned parties, There are only two reasons or excuses: either everyone concerned doesn&#8217;t know that an investor could expedite the transaction, or they&#8217;re greedy. Take your pick. A distressed homeowner seeking a short sale should only be concerned with one thing: Can/will the investor negotiate my short sale so that I am never held responsible for the mortgage deficiency? (Can I walk away from my distressed property without ever owing a dime?)</p>
<p>One more item: No one that I can find is satisfied with HAFA, or the Home Affordable Foreclosure Assistance plan. It was written by the banks. Go figure.</p>

<p>CNN Politics reports again on relevant facts on why the Making Home Affordable Plan is less than sterling in it&#8217;s intended results. The interested reader should follow the link below.</p>
<p>The underwriters tasked with considering mortgage modification applications are paid to consider the best interest of their respective banks. It takes an informed advocate (a US national attorney will do) to get the underwriter to see the wisdom of following the HAMP rules. </p>
<p>Notice the 31% of income rule and the need for an income. The statement that banks are prohibited from foreclosing while a homeowner is in modification negotiations is a key to why so many &#8216;trial modifications&#8217; are being rescinded. You don&#8217;t think the banks would rescind if they saw more financial gain in foreclosure, do you? </p>
<p>The REST Report has proven itself 4000 times as a tool to make the mortgage servicer&#8217;s behave. It&#8217;s their own software.</p>
<p>Yes, there are &#8216;hundred&#8217;s of thousands of trial modifications&#8217; in the pipeline. 230,000 to be exact. That is 9%. Hey! Big deal, huh?</p>
<p>The federal administrators that profess satisfaction with a 13% modification rate are the ones that are fooling all those media reporters out there. If the government says it, it must be so. Meanwhile, the trusting homeowner goes underwater, really wanting to believe that someone is on their side. Maybe. <p>There are stories every day about mortgage lenders that on trusting but distressed homeowners. If you think your lender is there to help you, you are living in a dream world. Of course you should be able to get your mortgage modification for free, but the old adage stands today: Free is worth what you paid for it.</p>
<p>The REST Report has proven itself as an indispensable tool in getting a beneficial, affordable mortgage modification.</p>
<p>Your mortgage servicer is indifferent, or even hostile. They want your property for free. In other words, when it comes to cleaning up a failed bank, creditors come before homeowners. </p>
<p>The problem lies not with the Home Affordable Mortgage Plan (HAMP) but with the administration of it. Your lender, unbeknownst to you, has calculated that they will make more money foreclosing on you. &#8220;As the crisis unfolds, one thing is consistent: Despite the made-for-TV promises by bank executives and government officials, when it comes to avoiding foreclosure, U.S. homeowners are almost entirely on their own.&#8221;</p>
<p>The U.S. Department of Housing and Urban Development will admit they are just as unsuccessful as the unfortunate victims of the nation&#8217;s biggest lenders. They are not attorneys. They are simply advisors. They can show you how to apply; they can&#8217;t make the banks behave.</p>
<p>Stories abound of banks foreclosing in the midst of mortgage modification negotiations. This is a clear violation of HAMP guidelines. &#8220;Oh, well,&#8221; says the bank. A phone call doesn&#8217;t get it when facing a foreclosure. The bank knows that, but they continue to put these excuses forward; and no one calls them on it.</p>
<p>There is serious dispute as to Option ARM mortgage qualify just as much as any other distressed mortgage.</p>

More likely, contracting with an investor firm that has a reputation for negotiating mortgage deficiencies and closing on short sales in 30-60 days will solve your problem and let you start repairing your life sooner.</p>
<p>Get this through your head. Your mortgage servicer wants your house. They get paid for foreclosure. Nothing else. They have no regard for you. The secret is to get to your mortgage investor and your mortgage servicer will make them behave.</p>
<p>Whatever you do, avoid the HAFA, or Home Affordable Foreclosure Assistance Program. No one who has entered the program has been satisfied. The banks wrote the law. Who would you guess the law benefits?</p>

<p>The short sale and mortgage modification application and process are increasingly becoming identical. Although the official federal rules don&#8217;t<br />
take effect until April, the noose is tightening around reluctant and treacherous lenders who obfuscate, delay, and avoid professional distressed mortgage assistance. My conversation with an distressed homeowner will now be much simpler; &#8220;In a perfect world, do you want to keep your home and get a mortgage modification? or short sell your property and liquidate your obligation?. The paperwork and supporting documents are identical, and now, the lender will be held accountable in good-faith negotiations regardless of the decision.</p>
<p>Having represented a firm that is 95% successful in beneficial, affordable mortgage modifications for nine months, I can now refer a distressed homeowner to an efficient short sale negotiator who will hold the lender&#8217;s feet to the fire and require them to respond professionally and promptly.<br />
This is done by having the same calculation parameters, the direct numbers of the actual lender decision-makers, and hundreds of similar short sale files so as to tie up the bank negotiator so they have no escape. The firms I represent can reasonably assure the distressed property owner that answers will be provided in 30 to 60 days.</p>
<p>This eliminates horror stories like the one linked below. The press is full of the stories of short sale candidates that can&#8217;r sell their property because the lender won&#8217;t respond. The second half of the secret sauce is to have a private investor with the capital to purchase the property the instant a slae price is reached with the lender.</p>
<p>The time for lender excuses is over. The private money in the United States will solve the stagnant mortgage credit market, if we can just get out the word on our ability.</p>
<p>Nationally, short sales nearly tripled to 40,000 in the first six months of 2009 compared with the same period a year earlier, according to a report from the Office of Thrift Supervision, the federal bank regulator, and the Office of the Comptroller of the Currency.</p>
<p>The fact is that the individual home seller, real estate agent, investor, or end buyer will never get the decision maker on the line. But we do, because of client volume and the strength of funds. Since we have a bigger database and negotiation experience, we can avoid the silly counter-offers that lenders use to stall the short sale process.</p>

<p>Almost daily I read yet another story relating how a bank simultaneously offered a mortgage modification and foreclosed on the hapless homeowner. Protection against this consists of getting the REST Report and monitoring your county trustee for an errant foreclosure sale date.</p>
<p>Disorganization within the big banks that service mortgages has made a bad problem worse. Simply, the Foreclosure Department doesn&#8217;t talk to the Loss Mitigation Department.</p>
<p>The lender reversed the sale by paying the man who&#8217;d bought the home an extra $19,500 on top of the $86,000 he&#8217;d paid at the auction. Does any reader believe the lender did that of their own free will? I gotta bridge in the middle of the desert I&#8217;d like to sellya.</p>
<p>No matter how &#8216;rare&#8217; the loan servicers say this simultaneous travesty is, there are stories like this almost daily. </p>
<p>&#8220;Basically, you have the right hand at the mortgage company not knowing what the left hand is doing,&#8221; said Mark Pearce, North Carolina&#8217;s deputy commissioner of banks. Communication glitches and mistakes are &#8220;systemic, more than anecdotal&#8221; among mortgage servicers, he said.</p>
<p>Under HAMP, or the Home Affordable Mortgage Plan, which requires servicers to follow a set of guidelines for modifications, servicers must give borrowers a written denial before foreclosing. When Gomez called Bank of America about the sale, she was told there was a mistake but nothing could be done. She did get a denial notice — some three weeks after the house was sold and just days before she was evicted.</p>
<p>If you insist on reading the linked article, the biggest mistake you can make is thinking that since your lender is not mentioned, it doesn&#8217;t matter.</p>
<p>But it does. It could be any lender. It could be yours.</p>
<p>Servicers operating under the two-year-old Home Affordable Mortgage Plan (HAMP) are forbidden from auctioning someone&#8217;s home while a modification decision is pending. It happens anyway.</p>
<p>Consumer advocates say the lapses continue because they go unpunished. Do not believe for a minute that the money paid for a federal mortgage modification is enough payment for that same mortgage modification. If you listen carefully, you can hear the collective yawn of thos big banks. </p>
<p>I do not buy the excuse for banks fumbling mortgage modifications or short sales because of deluge of applications. How often did you get away with losing your homework in school? How often does anyone read about the banks losing a new mortgage purchase application?</p>
<p>The lender in question services &#8220;more than 10 million mortgages — the vast majority without a hitch.&#8221; Notice the quote does not say how many mortgage modifications are accomplished &#8220;without a hitch.&#8221; I invite the reader to watch the first two videos on this blog.</p>
<p>The article twice cites regulations from the HAMP program. What it doesn&#8217;t say is that the majority of mortgages do not qualify for HAMP, but they do qualify for lender in-house programs &#8211; that the call-center you&#8217;re talking to may not even know about. Many of these programs have better terms than HAMP.</p>
<p>To contest a foreclosure under the federal HAMP program, Maggiano, the U. S. Treasury official, said a homeowner should call the HOPE Hotline, 888-995-HOPE, a Treasury Department-endorsed hotline staffed by housing counselors. Those counselors can escalate the case if the servicer still won&#8217;t correct the problem, she said.</p>
<p>Why anyone would wait for a treacherous and sneaky foreclosure is beyond me. This advice is from a federal entity that admits it&#8217;s only 5% effective in obtaining a mortgage modification. They can only show you how to do the work yourself. Best of luck on that.</p>
<p>&#8220;I uniformly hear from attorneys and counseling advocates on the ground that the HOPE Hotline simply parrots back what the servicers have said,&#8221; said Alys Cohen, an attorney with the National Consumer Law Center. Cohen said she&#8217;d voiced her concerns with Treasury officials, who indicated they&#8217;d make improvements.</p>
<p>Under the current rules for the federal program, servicers have been barred from conducting a foreclosure sale if the homeowner requested a modification but are allowed to push along the process, even set a sale date. That allows them to foreclose more quickly if they determine the homeowner doesn&#8217;t qualify for a modification.</p>
<p>As a result, a homeowner might get a modification offer one day and a foreclosure notice the next. As of March, servicers were pursuing foreclosure on 1.8 million residences, according to LPS Applied Analytics. Appearance in court and the REST Report would stop that.</p>
<p>Treasury has yet to set any penalties for servicers who don&#8217;t follow the rules. Several distressed homeowners are having success on their own in court preventing foreclosure with the REST Report.</p>

<p>Again, here comes another web article about those &#8220;Evil Mortgage Modifiers&#8221;</p>
<p>I&#8217;ve written about this in the past and will continue to. (Although my articles will probably get shorter and shorter) Avoiding mortgage modification fraud is pretty simple. Do it yourself with the REST Report.</p>
<p>Since this past June, attorneys can&#8217;t get anything accomplished in bank mortgage modification negotiations that you can&#8217;t get done. Attorneys only benefit you if and when you&#8217;re called to court in a foreclosure defense.</p>
<p>No attorney anywhere is monitored by the Better Business Bureau. </p>
<p>On a personal note, I used to represent two outstanding attorney firms. They were incredibly proud and jealous of their 97% success rate. They were very, very, VERY careful to not accept a file they couldn&#8217;t get done. Currently, aware attorneys are using the REST Report to calculate advisable mortgage modifications. The problem is that the banks have learned that they aren&#8217;t held responsible for good faith negotiations to attorneys any more than they are to the distressed homeowner. </p>
<p>Your initial consultation should be free. That avoids up-front fee concerns. It assures the attorneys can get it done anyway.  The issue of &#8216;up-front fees&#8217; is now moot because no attorney can afford to keep their doors open when getting sandbagged by the lenders. The answer is to file your mortgage modification application on your own and decide if you want legal representation if and when your miscreant lender calls you into court by illegally foreclosing on you. </p>
<p>Now, of course, you need to verify that any third party help you get is observing the Federal Trade Commission&#8217;s MARS Rule.</p>
<p>The internet being what it is, certain search terms need to be empahasized so that you can find the best information. The REST Report is best classified as loan modification software, or mortgage modification software. It&#8217;s claim to fame is that you use it to calculate Net Present Value exactly the way the banks do, using the same software. It is best used as a do it yourself loan modification or do it yourself mortgage modification.</p>

Anyone who has successfully negotiated their own mortgage modification without the REST Report will say that it is a full time job. </p>
<p>The banks don&#8217;t make it easy. The second video on this blog is a testament by a major bank administrator that they actively avoid any negotiations. </p>
<p>The media is fond of quoting specific lower modified monthly mortgage payments, but they always seem to miss the critical statistic. A beneficial mortgage modification should be a new (permanent) monthly mortgage payment that is 31 percent of the new, reduced, reliable, monthly income. Banks are also well known for offering new payments that THEY think the beleaguered homeowner can afford. Without the REST Report, you are palying poker one handed. They get to see your cards, you don&#8217;t get to see theirs. The REST Report is their hand.</p>
<p>This linked article concerns an underwater mortgage owner who has elected to strategically default on her mortgage. Given the legal assistance available currently, this is assuredly the worst option. The REST Report assures either a mortgage modification or short sale. Credit counselors agree that Deed-in-Lieu of foreclosure is the last option before foreclosure. Credit scores suffer equally. Considering that one might easily be on the hook for most, if not all, of the mortgage deficiency; it&#8217;s a bad idea.</p>
<p>The distressed homeowner that believes everything will be hunky-dory &#8220;after this crisis&#8221; is in La-La land. Foreclosure will haunt them for most of the next decade. These people are essentially resigning themselves to victim-hood. It&#8217;s really too bad.</p>
